Terms and conditions of the contract and the inspection

These terms and conditions take precedence over any oral or written representations by the Inspector.

BUILDING INSPECTIONS

Payment

The price quoted for the inspection report is to be paid at the time of booking or on the day of the inspection. Payment by cash, cheque, money order or EFT.

Cancellations

Cancellations made within 24 hours of the arranged inspection time will incur a $100 cancellation fee.

Report recipient

The report will been supplied to you (the named client) subject to these terms and conditions by the author. The author accepts no responsibility to other persons.

Australian Standards

The report will be prepared based on Australian Standard AS4349.1 - 2007 "Inspection of buildings Part 1: Pre-purchase inspections - Residential buildings".

Acceptance of these terms & conditions

After making the booking, the client is deemed to have accepted these Terms and Conditions upon the Inspector arriving at the property and commencing the inspection.

Prevailing Conditions

The report is based on the condition of the property and the prevailing structural, soil and weather conditions at the time of the inspection. Prolonged periods of wet or dry weather will cause structural changes to the property.

Limitations of the Visual Inspection

The report is based on a visual inspection of reasonably accessible parts of the property and does not cover enquiries of councils or other authorities. The report will not disclose defects in inaccessible areas, defects that are not reasonably visible, defects which may be apparent in other weather conditions or defects which have not yet arisen.

Plumbing + Electrical Services

The report does not include full assessment of plumbing or electrical services.

Pests

Your Building inspection is not an inspection for pests, including termites. A termite inspection can be requested at the same time as your building inspection for an additional fee. Clients wishing to have a full pest infestation check should arrange for a separate pest inspection. If termite activity or termite damage is observed by the Inspector, it will be noted in the report.

Exclusions

The Report does not cover the identification of toxic mould, asbestos related products or the condition or operation or safety of swimming pools, spas, rainwater or greywater treatment and similar facilities or the testing of services and appliances. The report does not cover all maintenance items, particularly those such as jamming doors, windows or catches, decorative finishes and hairline or slight cracks (Category 0 and 1 of Appendix C - Australian Standard AS2870-1996).

Limited Liability

The Inspector accepts no liability with respect to work carried out by other trades, consultants or practitioners referred by the Inspector. The Inspector's liability with respect to the advice given in this report shall be limited to a refund of the inspection fee.

  1. If you are dissatisfied with the Report you must give the Inspector written notice specifying the matters about which you are dissatisfied before taking any remedial action.
  2. Within 28 days of giving the notice, you and the Inspector shall meet to attempt to resolve the matters.
  3. If at the expiration of 28 days from the giving of the notice any dispute, controversy or claim arising out of the matters shall remain unresolved, the matters shall be the subject of a mediation to be conducted by a mediator appointed by agreement between you and the Inspector or appointed by the Chairperson of The Institute of Arbitrators & Mediators Australia, with the cost of such mediation shared equally by both parties.
  4. In the event that the matter will not been resolved within 28 days after the appointment of a mediator, such dispute, controversy or claim may be submitted to litigation.

TERMITE INSPECTIONS

  1. Nothing in this report implies that areas of the property which were inaccessible or partly-accessible on the day of the inspection were not, or have not been, infested by termites. This report is not a guarantee that termite infestation does not already exist or may occur in the future.
  2. No inspection of furnishings or household items was made.
  3. This Report has been supplied to you (the named client) subject to these terms and conditions by the Inspector (named as 'Your Inspector/Architect'). The author accepts no responsibility to other persons.
  4. Having provided to you an opportunity to read the Terms and Conditions, the Inspector has proceeded to conduct the inspection of the property and to supply this Report on the basis that you have accepted the Terms and Conditions and/or are deemed to have done so upon the Inspector arriving at the property and commencing the inspection.
  5. The Report has been prepared by the Inspector based on Australian Standard AS3660.2-2000 'Termite Management - Part 2: In and around existing buildings and structures' and AS 4349.3 - 1998 "Inspection of buildings Part 3: "Timber pest inspections"

  12. This inspection is for subterranean termites only (commonly called 'white ants') and not for other pests. Clients wishing to have a full pest infestation check should arrange for a separate pest inspection.
  13. The Inspector's liability with respect to the advice given in this report shall be limited to a refund of the inspection fee.

  18. This is not a structural damage report. The extent of damage noted in this report may not be the full extent of damage to the building. The inspector cannot see into walls or inaccessible areas. Timber-framed walls and timber-framed floors are locations where serious damage can occur and the structure of neither of these areas is likely to have been visually inspected for this report. Therefore, if evidence of timber pests was found elsewhere, it must be expected that damage will exist in these areas also. Even of no evidence was sighted, there may be damage to these areas. In order to determine the extent of damage and repairs needed, it will be necessary to dismantle parts of the building. A qualified person like a builder or engineer should be engaged to assess the extent of damage and repairs needed.
